Dispute resolution strategy during Corona: when corporate mediation makes sense
The impact of COVID-19 around the globe has caused market volatility, business conflicts and corporate disputes. How are courts, arbitrators and parties dealing with complex business disputes during this pandemic? The courts are catching up after weeks of closure and arbitrations are adjusting to online hearings, all resulting in delays. In order to contain, manage and resolve a corporate conflict there is an emerging need for alternative dispute resolution, more so now then ever before. Now is the time to break away from convention and seek creative solutions to resolve a dispute. Since mediation is flexible, the online mediation procedure to be used can be adapted to the needs of the parties. Furthermore, in mediation the parties can resolve their disputes in ways that would never be possible in a court of law or in arbitration.
